Terms of Use

1. Acceptance of Terms

By accessing or using Tagpo's website (tagpoconnect.com) and services (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Tagpo under the Electronic Commerce Act of 2000 (Republic Act No. 8792) and the Consumer Act of the Philippines (Republic Act No. 7394).

2. Definitions

  • "Service" refers to Tagpo's website, NFC card products, digital profile platform, and related features.
  • "NFC Card" refers to the physical near-field communication card sold by Tagpo.
  • "Profile" refers to the digital profile you create and link to your NFC Card.
  • "User," "you," or "your" refers to any individual who accesses or uses the Service.
  • "We," "our," or "us" refers to Tagpo.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and not share it with third parties.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. NFC Card Orders and Payment

When you order an NFC Card from Tagpo:

  • All prices are displayed in Philippine Pesos (PHP) and include applicable taxes unless stated otherwise.
  • Payment is processed through PayMongo, our authorized payment gateway. By making a payment, you authorize PayMongo to charge your selected payment method.
  • Orders are confirmed upon successful payment. You will receive a confirmation email with order details.
  • Shipping is available within the Philippines. Delivery timelines vary by location and are estimates, not guarantees.
  • We reserve the right to refuse or cancel orders due to stock unavailability, pricing errors, or suspected fraudulent activity.

5. Shipping and Delivery

In accordance with the Consumer Act of the Philippines (RA 7394) and DTI regulations:

  • We ship NFC cards via courier partners within the Philippines.
  • Estimated delivery times are provided at checkout and are subject to courier capacity and your location.
  • You will receive tracking information once your order is dispatched.
  • Risk of loss transfers to you upon delivery to the courier. We are not liable for delays caused by the courier, weather, or events beyond our control.
  • If you do not receive your order within the estimated timeframe, contact hello@tagpoconnect.com for assistance.

6. Returns and Refunds

We adhere to the DTI's Consumer Protection guidelines:

  • Defective or damaged cards may be returned within seven (7) days of receipt for a replacement or refund.
  • Custom-engraved or personalized cards that are not defective are non-refundable.
  • To initiate a return, email hello@tagpoconnect.com with your order number and photos of the defect.
  • Refunds are processed to the original payment method within fourteen (14) business days of approval.
  • Shipping costs for returns of defective items are borne by Tagpo.

7. Digital Profile and Content

You retain ownership of the content you upload to your Profile. By using the Service, you:

  • Grant Tagpo a limited, non-exclusive license to display your Profile content when your NFC Card is tapped.
  • Represent that you have the right to use all content (images, logos, trademarks, links) in your Profile.
  • Agree not to upload content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable.
  • Acknowledge that Profiles are publicly accessible when shared via NFC card tap or direct link.

We reserve the right to remove or restrict Profiles that violate these Terms or applicable law, without prior notice.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of Philippine law.
  • Attempt to gain unauthorized access to other users' accounts, data, or our systems.
  • Interfere with or disrupt the Service, servers, or networks.
  • Reproduce, distribute, or modify the Service without our written consent.
  • Use automated tools (bots, scrapers) to access the Service without permission.
  • Impersonate another person or entity in your Profile.
  • Use the Service to transmit malware, spam, or malicious content.

9. Intellectual Property

The Service, including its design, logo, text, graphics, software, and the Tagpo brand, is owned by Tagpo and protected by Philippine intellectual property laws (Republic Act No. 8293, Intellectual Property Code). Your digital Profile content remains your property. These Terms do not transfer any intellectual property rights to you beyond the limited license to use the Service.

10. Limitation of Liability

To the maximum extent permitted by Philippine law:

  • The Service is provided "as is" without warranties of any kind, whether express or implied.
  • Tagpo shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific NFC Card order giving rise to the claim.

This limitation does not apply to liability that cannot be excluded under the Consumer Act of the Philippines.

11. Indemnification

You agree to indemnify and hold harmless Tagpo, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Account Termination

Either party may terminate this agreement:

  • You may delete your account at any time through your dashboard settings.
  • We may suspend or terminate your account for violation of these Terms, with notice where practicable.
  • Upon termination, your right to use the Service ceases immediately.
  • Provisions that by their nature should survive (intellectual property, limitation of liability, indemnification) remain in effect after termination.

13. Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms shall be resolved:

  • First, through good-faith negotiation between the parties.
  • If unresolved within thirty (30) days, through mediation before a mutually agreed mediator in the Philippines.
  • If mediation fails, through binding arbitration administered under the arbitration laws of the Philippines.

You may also file a complaint with the Department of Trade and Industry (DTI) for consumer-related disputes.

14. Electronic Transactions

By using the Service, you consent to conducting transactions electronically as provided under the Electronic Commerce Act of 2000 (RA 8792). Electronic records, electronic signatures, and electronic transactions carried out through the Service have the same legal effect as paper-based transactions under Philippine law.

15. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least fifteen (15) days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a Philippine court, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
